General terms and conditions of the Gouden Cirkel

1.    General

These general terms and conditions apply to members of the Gouden Cirkel, implemented by Het Anker N.V., established in Mechelen, hereinafter referred to as ‘Het Anker’. By subscribing to the Gouden Cirkel, members agree to the following terms and conditions, which they have been able to read on the company website. Additional terms and conditions stipulated by members are excluded subject to prior, written and express consent from Het Anker.

Het Anker reserves the right to modify these general terms and conditions. The valid general terms and conditions can be found on the company website. By making use of the Gouden Cirkel membership after these general terms and conditions take effect, members indicate that they agree to the new general terms and conditions.

2.   Membership

Any natural person over the age of 18 years can become a member of the Gouden Cirkel by completing and submitting the subscription form intended for this purpose.

Participants are obliged to provide accurate, up-to-date and full information when registering for the Gouden Cirkel.

The application is assessed by Het Anker and may be rejected without giving reasons. Once the application has been accepted, the Gouden Cirkel passport is sent by post and can then be used.

3.   Passport

The Gouden Cirkel passport remains the property of Het Anker N.V. The Gouden Cirkel passport is personal and cannot be passed on or lent out. The passport is only valid when it bears the personalised sticker in the name of the member, affixed in the relevant place on page 1 of the passport. This personal sticker is included in the welcome package that is sent by post once members have subscribed. Het Anker can have the passport withdrawn without giving reasons. If the passport holder terminates his/her membership of the Gouden Cirkel, he/she should hand in the Gouden Cirkel passport to Het Anker.

4.   Advantages

The advantages offered further to membership of the Gouden Cirkel are without any obligation for members. Het Anker can attach terms and conditions to the advantages and can request participants at any time to provide valid proof of their identity so as to be able to benefit from these advantages. The advantages may not be transferred, exchanged or redeemed in cash or in return for other products or services. The terms and conditions may not be fulfilled with backdated effect. Het Anker reserves the right to modify and/or withdraw the advantages. Het Anker also reserves the right to modify the Gouden Cirkel programme or terminate it entirely. Such modifications or termination will be announced by Het Anker on the website and/or via other media.

In the event of any suspicion of improper use or fraudulent action involving Gouden Cirkel membership, Het Anker is entitled not to grant the related advantage and/or to require the return of the advantage granted.

5.    Liability

Het Anker is under no circumstances liable for any damage resulting from participation or for any technical disruptions, defects or delays related to participation.

Het Anker does not accept any liability for the loss or theft of the Gouden Cirkel passport, or for unauthorised use of and/or fraudulent action involving the Gouden Cirkel passport.

6.   Privacy

The data provided by members are included in the data file and treated as confidential. These data are used to fulfil the agreement reached, to send information, offers and newsletters and for analysis and evaluation purposes.

Members have a legal right to consult and, if appropriate, correct their personal data. Subject to proof of identity (copy of identity card), members can obtain written notification of their personal data free of charge by means of a written, dated and signed request sent to Het Anker nv, Guido Gezellelaan 49, 2800 Mechelen – info@hetanker.be. If necessary, members can also request the rectification of data that may be incorrect, incomplete or irrelevant.

Members may object to the use of their data for direct marketing purposes free of charge. To this end, members may contact Het Anker nv, Guido Gezellelaan 49, 2800 Mechelen – info@hetanker.be.

Het Anker treats personal data as confidential information and will not pass on, hire out or sell these data to third parties.

Members are responsible for ensuring the confidentiality of their login data and the use of their password. Passwords are encoded when stored. Consequently, Het Anker does not have access to your password.

Het Anker keeps anonymous website visitors statistics so as to be able to see which pages of the website are visited to what extent.

7.    Invalidity – Non-waiver

If a provision in these general terms and conditions is declared invalid, unlawful or void, this will not under any circumstances affect the validity, the lawfulness and the applicability of the other provisions.

Should Het Anker neglect at any time to enforce one of the rights listed in these general terms and conditions, or to exercise any of these rights whatsoever, this will never be seen as a waiver of this provision and will never affect the validity of these rights.

8.   Applicable law – Disputes

These general terms and conditions are governed by Belgian law.
